Von diesen Allgemeinen Geschäftsbedingungen abweichende oder ergänzende Regelungen werden nur dann Vertragsbestandteil, wenn dies von „Hand in Hand“ ausdrücklich schriftlich bestätigt wurde.

Spendenangebote
Bei der Darstellung von Projekten von „Hand in Hand“ auf der Website www.palliativkinder.at handelt es sich nicht um rechtlich bindende Angebote. Die Spende dient bei jedem Projekt einem anderen Zweck (etwa Kauf eines Rollstuhls, Bezahlung einer bestimmten Behandlung, usw.). Bei Nichterreichung des geplanten Finanzierungsbedarfs für das jeweilige Projekt kann der Spendenzeitraum verlängert werden oder das Projekt mit dem bis dahin erwirtschafteten Spendenerlös abgeschlossen werden, indem entweder die Familie den Differenzbetrag aufbringt oder dieser aus dem allgemeinen Topf finanziert wird.
Sollte ein Projekt aus wichtigem Grund (z.B. Krankheit oder Unterfinanzierung) vom Antragsteller nicht umgesetzt werden können, so handelt es sich um einen Projektabbruch. Diesfalls werden die Spenden für ein anderes dem Vereinszweck entsprechenden Projekt verwendet, es sei denn, der Spender widerspricht einer solchen Verwendung ausdrücklich.
Der Verein behält sich das Recht vor, Spenden ohne Nennung von Gründen abzulehnen, worüber wir den Spender unverzüglich informieren werden.
Ablauf der Spende
- Wählen Sie ein Projekt, wofür Sie spenden möchten.
- Füllen Sie das Spendenformular mit Spendenbetrag, Anrede, Vorname, Nachname, E-Mail Adresse – und bei wunschgemäßem Erhalt einer Spendenquittung zusätzlich mit Geburtsdatum, Wohnadresse, Ort, Postleitzahl sowie Land aus.
- Wählen Sie das Zahlungsmittel aus, mit dem Sie spenden möchten. Sie haben die Möglichkeit, Ihre Spende mittels Paypal oder mittels Überweisung zu bezahlen.
- Bestätigen Sie durch Anklicken der jeweiligen Kästchen, dass Sie die AGB sowie die Informationen zum Datenschutz gelesen und akzeptiert haben.
- Mit einem Klick auf die Schaltfläche „Jetzt spenden“ erteilen Sie „Hand in Hand“ den Auftrag, Ihre Spende für das von Ihnen gewählte Projekt zu verwenden.
- Sie werden auf die Seite unserer Zahlungsdienstleister weitergeleitet. Bitte füllen Sie hier Ihre Angaben zur gewünschten Zahlungsmethode aus.
- Nach erfolgreicher Übermittlung der Zahlungsdaten werden Sie automatisch auf die Website von „Hand in Hand“ zurückgeleitet und erhalten sowohl auf der Website als auch an die von Ihnen angegebene E-Mail-Adresse eine Bestätigung über die erfolgreich getätigte Spende.
Kein Rücktrittsrecht
Wir weisen darauf hin, dass wir als spendensammelnder Verein nicht dem Fern- und Auswärtsgeschäfte-Gesetz unterliegen. Somit gibt es für eine online getätigte Spende kein gesetzlich normiertes Rücktrittsrecht.
Schadenersatz
Die Spenderin/der Spender, sowie die Antragstellern für ein Projekt, haftet dem Verein gegenüber für alle Schäden, die aus der missbräuchlichen Verwendung des online Spendens (beispielweise durch die unbefugte Eingabe von Daten Dritter) entstehen.
